Banzai Bet Terms and Conditions

1. The following definitions apply to these terms and conditions:

1.1.1. “Access Device” refers to any electronic means of accessing the Services, including but not limited to computers, smartphones, feature phones, tablets, touch devices, or any home entertainment system such as video game consoles and smart TVs (or any other remote means);

1.1.2. “Bonus Terms” denotes any terms and conditions and/or rules related to promotions, bonuses, and special offers which may apply to any part of the Services at various times;

1.1.3. “General Terms” signifies the terms and conditions outlined in this document;

1.1.4. “Group” includes Nevadin Limited, registered under No. HE 433770, located at Agias Zonis & Thessalonikis, NICOLAOU PENTADROMOS CENTER, Floor 10, Flat/Office 1001A, BLOCK B, 3026, Limassol, Cyprus, and Evolut Interactive N.V., registration No. 161541, located at Klipstraat 13, Willemstad, Curacao. The division of responsibilities between the companies within the Group is detailed in these Terms and Conditions;

1.1.5. “Operator” means Evolut Interactive N.V., registration No. 161541, located at Klipstraat 13, Willemstad, Curaçao, holding a Curacao gaming license;

1.1.6. “Payment Processor” refers to Nevadin Limited, a company registered at Agias Zonis & Thessalonikis, NICOLAOU PENTADROMOS CENTER, Floor 10, Flat/Office 1001A, BLOCK B, 3026, Limassol, Cyprus, with registered company number HE 433770;

1.1.7. “Privacy Policy” indicates the Operator’s privacy policy accessible via the Privacy Policy link, which is an integral part of Banzai Bet Terms and Conditions;

1.1.8. “Rules” refers to the Betting Rules and Game Rules applicable to the relevant type of betting and/or gaming, as specified in more detail further on;

1.1.9. “Refund” means a reversal of a means upon a Player’s request for a deposit made in the Player Account that has not been used for the Services.

1.1.10. “Services” denotes the services offered by the Operator through the Website and/or via any Access Device application at any given time;

1.1.11. “Terms of Use” includes (a) the General Terms; (b) the Privacy Policy; (c) where relevant under the applicable Rules, Bonus Terms, and Additional Terms relevant to the Services that You are using;

1.2. By using and/or visiting any section of the Website or by opening an account with the Operator through the Website, You agree to be bound by the Terms of Use and accordingly: (a) agree to the use of electronic communications to enter into contracts; (b) waive any applicable rights or requirements for a handwritten signature, to the extent permitted by applicable law; (c) agree that to use our service, You need to provide us with certain personal information which will be processed according to our Privacy Policy. The Terms of Use do not affect your statutory rights.

1.3. Additionally, by playing any game, placing a bet using the Services, or otherwise using the Services, You agree to be bound by the Rules of any game You play (“Game Rules”), as outlined under the relevant general Help section and any Rules tabs, for any new games, the rules applicable to such games; any Bonus Terms; any terms and conditions related to withdrawals, and any other terms applicable to the Services and/or which You are required to confirm Your agreement to as part of the Services.

1.4. The original text of the Terms of Use is in English, and any interpretation will be based on the original English text. If the Terms of Use or any related documents or notices are translated into another language, the original English version will prevail.

Note that the Terms of Use are subject to change, as detailed in paragraph 3 below.

1.6. If You do not agree to accept and be bound by the Terms of Use, please do not open an account or continue to use Your Account. Continued use of any of the Services will constitute acceptance of the Terms of Use that have been notified to You as being in force from time to time.

1.7. For clarity, each and all sections of the Website are governed by the Terms of Use, and You should ensure that Your use of the Services always complies with the Terms of Use.

2. General Regulations

2.1. The Terms of Use are agreed upon by You, the Operator, and the Payment Processor.

2.2. All information on the Banzai Bet is provided by the service provider of the Website. Evolut Interactive N.V. operates the Website.

2.3. Services for cardholders are provided by Nevadin Limited, a company registered at Agias Zonis & Thessalonikis, NICOLAOU PENTADROMOS CENTER, Floor 10, Flat/Office 1001A, BLOCK B, 3026, Limassol, Cyprus.

2.4. For any inquiries and complaints, please direct them to Evolut Interactive N.V.

2.5. In these Terms and Conditions, Nevadin Limited as the Payment Processor and Evolut Interactive N.V. as the Operator are referred to as Evolut, “We”, “Us”, “Our”, “Management”, “Site” or “Company”. The Player and registered Account Holder are referred to as “You”, “Yours”, “Customer” or “The Player”.

2.6. Concerning terms and conditions related to monies held in Your Account, they pertain to any company within the Group holding such funds and shall (where appropriate) include our agents, partners, and suppliers.

3. Changes to Terms of Use

3.1. Banzai Bet may occasionally need to amend the Terms of Use for various reasons, including (but not limited to) commercial considerations, compliance with laws or regulations, adherence to instructions or guidance from regulatory bodies, or for customer service purposes. The most current version of the Terms of Use is accessible via the Terms and Conditions link in the footer of the Website.

3.2. If we intend to make significant changes to the Terms of Use, we will provide You with as much advance notice as reasonably possible, using one of the methods described in paragraph 3.3. For minor or non-significant changes, we may not provide any notice, so it is advised that You regularly review the Terms of Use through the Terms and Conditions link on the Website.

3.3. When we make changes to the Terms of Use that we wish to notify You of, we will do so through a method of notification that we, at our discretion, consider appropriate.

4. Account Opening

4.1. To place a bet or play a game using the Services, You need to open an account with the Operator (“Your Account” or “Account”).

4.2. To open Your Account for use with the Services, You can:

4.2.1. Click on Sign Up on the banzai Bet website and follow the on-screen instructions; or

4.2.2. Use another Account opening method as may be offered by the Operator from time to time;

4.3. When opening Your Account, You will be asked to provide personal information, including Your name, date of birth, and appropriate contact details, such as an address, telephone number, and email address (“Your Contact Details”). You may update Your Contact Details from time to time by contacting Customer Services, through the My Account management page on the Website, or by using another method offered by the Operator.

4.4. By opening Your Account, You warrant that:

4.4.1. You understand and accept the risk that, by using the Services, You may win or lose money;

4.4.2. You are: (a) over 18 years of age; and (b) above the legal age for gambling or gaming activities under the law or jurisdiction that applies to You (the “Relevant Age”);

4.4.3. Gambling is not illegal in the territory where You reside;

4.4.4. You are legally able to enter into contracts;

4.4.5. You have not been excluded from gambling; and

4.4.6. You have not previously had an Account closed by us for any reason.

4.5. Your Account must be registered in Your own, correct name and personal details and issued only once for You, without duplication through any other person, family, household, address (postal or IP), email address, Access Device, or any environment where Access Devices are shared (e.g., schools, workplaces, public libraries, etc.) and/or account in respect of the Services. Any other accounts You open with us, or beneficially owned by You in relation to the Services, shall be considered “Duplicate Accounts”. We may close any Duplicate Account (but are not obliged to do so). If we close a Duplicate Account:

4.5.1. All bonuses, free bets, and winnings accrued from such bonuses and free bets obtained using that Duplicate Account will be void and forfeited;

4.5.2. Banzai Bet may, at our discretion, void all winnings and refund all deposits (less amounts in respect of void winnings) made in respect of that Duplicate Account and, to the extent not recovered by us from the relevant Duplicate Account, any amounts to be refunded to us by You in respect of a Duplicate Account may be recovered by us directly from any other of Your Accounts (including any other Duplicate Account); or

4.5.3. Banzai Bet may, at our discretion, allow the usage of the Duplicate Account to be deemed valid, in which case all losses and stakes placed by or for You through the Duplicate Account shall be retained by us.

5. AML Requirements: Verification of Your Identity

5.1. You warrant that:

5.1.1. The name and address You provide when opening Your Account are accurate; and

5.1.2. You are the rightful owner of the money that You deposit into Your Account at any time.

5.2. By agreeing to the Terms of Use, You authorize us to conduct any necessary verification checks, either by ourselves or as required by third parties (including regulatory bodies), to confirm these facts (the “Checks”). You agree that upon our request (including requests from the Payment Processor), You may be required to provide additional details regarding any information You have supplied to us, including details related to any deposits made into Your Account.

5.3. While Banzai Bet are performing any Checks, we may restrict Your ability to withdraw funds from Your Account and/or limit access to all or certain parts of the Website. Note that we may re-perform the Checks periodically for regulatory, security, or other business reasons. If these restrictions cause any issues, please contact us at [email protected].

5.4. In certain circumstances, we may need to contact You directly to request additional information to complete the Checks. We may, at our discretion, require You to provide notarized identification or certified ID according to the laws of Your jurisdiction, proof of address, utility bills, bank details, bank statements, bank references, documentation validating Your source of funds, or request video identification (video call or other video means at our discretion). Until this information has been provided to our satisfaction, we may restrict any activities related to Your Account. If we believe You have deliberately provided incorrect information, we may retain any amounts deposited in the Account following its closure.

5.5. It is an offense for individuals under the Relevant Age to use the Website. If we cannot confirm that You are the Relevant Age, we may suspend Your Account until we can verify Your age. If it is later proven that You were under the Relevant Age at the time of any gambling or gaming transactions:

5.5.1. Your Account will be closed;

5.5.2. All transactions made while You were underage will be void, and all related funds deposited by You will be returned via the payment method used for the deposit, wherever practicable;

5.5.3. Any deposits made while You were under the Relevant Age will be returned to You; and

5.5.4. Any winnings accrued during the time You were under the Relevant Age will be forfeited (and deducted from any deposit returned under paragraph 5.5.3). You will also return to us any such funds withdrawn from Your Account upon our demand.

6. KYC Policy Terms of Banzai Bet

6.1. To streamline the Verification process, follow these guidelines when submitting your documents:

  • Each document must be sent as a separate image.
  • Photo-captured images are preferred. If scanning, send documents as a .jpeg file.

6.2. When taking your pictures:

  • Ensure the first 6 and last 4 digits of your credit card number are visible, and the CVV is hidden.
  • The picture must be in focus, with all text easily readable.
  • Include the full passport photo page or ID in the shot, without covering any parts with your hand or fingers.
  • Use good lighting to avoid glare; do not use flash.

6.3. This process is required for responsible gambling and to comply with applicable laws.

6.4. Why do I need to verify my account at Banzai Bet?

  • Upon signing up, we check that you are over 18 and verify your identity, a process known as Know Your Customer (KYC). This is required by law and ensures responsible gambling.

6.5. What do I need to provide?

6.6. How can I send you my documents?

The quickest and easiest way to verify your account is online. You can also send the documents via email. Here are a few tips for getting it right the first time:

Sending your documents via email:

  • Take a photo of each document and save the photos (or scan them and save as a .jpeg).
  • Open the email account used to register on our Website.
  • Compose a new email addressed to [email protected].
  • Attach the photos.
  • Enter your account number or username in the ‘Subject’ bar.
  • Press ‘Send’.

When registering for an account, provide the following information for security reasons:

  • Your name and contact details, including a valid email address unique to your account.
  • Your date of birth (you must be at least 18 years old).
  • A unique username (containing only letters, numbers, underscores, and hyphens) and a password for secure account access.
  • A valid phone number unique to your account.
  • Your country of residence.

Banzai Bet registration page checks your details as you enter them and will notify you of any issues, allowing you to make corrections before clicking the ‘Create My Account’ button.

For legal reasons, you may not be able to access your account while traveling abroad.

We do not accept accounts or offer our products or services to clients residing in the following countries: Afghanistan, Angola, Barbados, Cuba, Comoros, Djibouti, East Timor, Eritrea, Faroe Islands, French Polynesia, Gambia, Grenada, Iran, Iraq, Japan, Libya, North Korea, Samoa, South Sudan, USA, US Minor Outlying Islands, France, Spain, The Netherlands, and the Dutch Caribbean Islands (Curaçao, Aruba, Bonaire, St. Maarten, St. Eustatius, and Saba).

Some of Banzai Bet products or services have additional restricted territories. Please check Annex 1 “The list of Game providers and restricted territories”.

The list of game providers and restricted territories may be amended from time to time.

7. Customer Information, Username and Password

7.1. After opening Your Account at Banzai Bet, You must take all reasonable measures to prevent disclosing Your username, password, and/or account number to anyone else. This includes, where practicable, ensuring that up-to-date security software is installed on Your Access Device.

7.2. All transactions where Your username and password and/or account number have been entered correctly will be considered valid, regardless of whether You authorized them. We shall not be liable for any claims if You disclose Your username, password, or account number to anyone else (whether deliberately or accidentally).

7.3. If You have lost or forgotten Your Account details or believe that such details are known to an unauthorized third party, please contact us immediately for a replacement at [email protected].

8. Payments and Refunds from Account

8.1. If You wish to participate in the Services, You must deposit funds into Your Account from an account or source of which You are the account holder. Such funds may then be used by You to place bets or play games. If You use a payment method where You are not the account holder, Banzai Bet reserve the right to treat any deposit as invalid (and any winnings from such deposit as void) until all relevant Checks are satisfactorily completed.

8.2. Withdrawals (including Refunds) will be processed within 7 (seven) days after the completion of KYC and the approval of Your Account. Note that Refunds are only performed if no game activity has occurred on Your account after the deposit of the funds reclaimed by You as Refund. All other withdrawals will be considered as pay-out of your winnings generated from using the Services.

8.3. To withdraw the deposit, place bets equal to the value of the deposit.

8.4. To request a Refund or any other withdrawal, please contact our support via email at [email protected] and provide all documents requested to complete Your KYC. The list of required documents will be detailed in the email sent to You by our support team.

8.5. Refund requests must be made no later than 7 (seven) days after the deposit of the respective funds into Your Account. After this period, all withdrawals will be considered as pay-out of your winnings generated from using the Services.

8.6. Withdrawals will be processed within 7 (seven) days after the completion of KYC and the approval of Your Account. For clarity, Your Account should not be used as a bank account, and if we detect deposits and withdrawals (including charge-backs) without corresponding betting or gaming activity, we reserve the right to deduct an administration fee (regardless of whether we close or suspend the account). Funds deposited in Your Account will not accrue interest. The time it takes for the funds to appear in Your personal bank account depends on the respective payment service provider or bank. Banzai Bet can confirm the pay-out of the funds upon your request if necessary.

8.7. You are responsible for reporting Your winnings and losses from the Services as required by Your local law or tax authorities.

8.8. You can set a deposit limit on Your Account for any one day. To set up a deposit limit, please contact [email protected]. Any confirmed reductions to your deposit limit will take effect immediately.

8.9. Subject to the terms regarding the Closure of Your Account or any other terms in these Terms and Conditions or any amendments thereof, You may request withdrawal of funds from Your Account at any time, provided that:

8.9.1. All payments made into Your Account have been confirmed as cleared and none have been charged back, reversed, or otherwise canceled;

8.9.2. Any Checks related to the Verification of Your Identity or Money Laundering Requirements have been completed to our satisfaction; and

8.9.3. You have complied with any other relevant withdrawal conditions affecting Your Account (e.g., any applicable Bonus Terms).

8.10. On any withdrawal approved by us, provided You give us sufficient information on how the funds should be transferred to You, we will return the relevant funds to You (less any charges incurred or any other amounts required to be deducted from Your withdrawal to comply with applicable law).

8.11. Banzai Bet will try to accommodate Your request regarding the payment method and currency of Your withdrawal, but this cannot be guaranteed. We may process and pay withdrawals using a different payment method than the one requested by You, such as through different payment providers, a bank draft, or wire transfer (any charges associated with relevant payment methods are set out on the Website). Similarly, the currency of Your withdrawal may not be the currency in which Your deposit was made or that was requested by You, and the conversion rate used by us will be at our discretion.

8.12. Inactive Account Fee: If You do not use Your Account for betting or gaming, making a deposit, withdrawal, or transfer, or if it is otherwise inactive for at least 6 consecutive months, it will become an “Inactive Account.” All Inactive Accounts will incur an “Inactive Account Fee” of 50 EUR per month. We will notify You when Your Account becomes inactive, at least 14 days before any Inactive Account Fee is deducted.

8.13. LIMITATIONS: Banzai Bet may set at our discretion minimum and maximum deposit and withdrawal limits for You. The common minimum withdrawal size is 10 EUR.

8.13.1. The maximum withdrawal per Client in Banzai Bet is:

No more than 5,000 EUR (or equivalent in another currency) per day;

No more than 15,000 EUR (or equivalent in another currency) per week (Monday-Sunday);

No more than 50,000 EUR (or equivalent in another currency) per calendar month.

8.13.2. We reserve the right to change these limits (increase/decrease) unilaterally at our discretion, including individually for every Client (without changing these Terms of Use).

8.14. All payout requests are processed in the order they are received, usually within 72 hours if the requested amount does not exceed 1,000 EUR (or equivalent in another currency) and usually up to 7 days if the requested amount exceeds 1,000 EUR.

8.15. Withdrawals are processed without commission. The commission for deposits depends solely on the user’s payment system.

9. Bonuses

9.1. The Operator reserves the right to remove, add, or change any bonus available in the account of any Client that has not been claimed. Any claimed and active bonus will not be removed by the Operator under regular circumstances.

9.2. Bonuses may have wagering requirements attached to them. These requirements will be clearly displayed before the Customer decides to use a bonus. Withdrawal amounts will only be possible from the real money balance, and the bonus money balance will be lost upon withdrawal. The Operator has the right to determine which games and services contribute what amount to the wagering requirements. The wagering requirements have a minimum of 15 times the amount of the bonus and the real money sum contributing to the bonus figure.

9.3. Banzai Bet bonuses can be received once per person (Client), household, address, mobile phone, shared computer, and shared IP address. Risk-free bets on any games or services do not count toward the wagering requirements. Winnings from free spins are added to the real money balance.

9.4. The maximum amount of money that can be won from a no-deposit free spin bonus and gameplay with the mentioned bonus funds is 50 EUR or the equivalent in another currency. Any winnings exceeding 50 EUR without making a real money deposit will be void and kept by the Operator. For example, if a customer receives a no-deposit free spins bonus, plays out the free spins, and wins 10 EUR, then plays other games and wins 90 EUR, totaling 100 EUR, the customer has exceeded the cap of 50 EUR winnings. In this case, 50 EUR will be available for withdrawal, and 50 EUR will be kept by the Operator.

9.5. The maximum bet with an active bonus is 5 EUR per spin or 0.5 EUR per bet line. The Operator reserves the right to void bets and wager turnovers resulting from larger bets made on the Operator’s games and/or services.

9.6. The Operator reserves the right to impose various restrictions on different countries where Clients may reside regarding bonuses for undisclosed reasons. We further reserve the right to offer specific bonuses to individual clients or client groups and their termination, change, or other alteration without explanation and/or compensation in any form.

9.7. If a client or group of clients abuses bonuses, the Operator has the right to confiscate any winnings and close the client’s account(s). Abusive behavior towards bonuses and/or bonus abuse includes:

9.7.1. Placing bets and/or wagers amounting to the maximum allowed per bonus terms to increase variance and balance.

9.7.2. Lowering the bet and/or wager size after a big win and switching to a game with lower volatility.

9.7.3. Making deposits to cap out the bonus amount but not more, applicable to match bonuses of 50% and above.

9.7.4. Engaging in other unusual behavior that the Operator may consider bonus abuse.

9.8. After an account has been flagged for bonus abuse, it is forbidden to use any other bonuses and/or participate in promotions on the Website.

10. Information about the Legality of the Website

10.1. Access to or use of the Banzai Bet website or any of the Services via the Website may not be legal for some or all residents of or persons in certain countries. We do not intend for the Website to be used for betting, gaming, or any other purposes by persons in countries where such activities are illegal, including the United States of America and those territories listed on the Website. The fact that the Website is accessible in such a country, or appears in the official language of such a country, shall not be construed as a representation or warranty regarding the legality of accessing and using the Website, making deposits, or receiving any winnings from Your Account. The availability of the Website does not constitute an offer, solicitation, or invitation for the use of or subscription to betting, gaming, or other services in any jurisdiction where such activities are prohibited by law.

10.2. It is Your responsibility to determine the law that applies in the location where You are present. You should ensure that You are acting legally in Your jurisdiction when opening Your Account and/or using the Website, and You represent, warrant, and agree that You will do so.

10.3. If it becomes apparent to us that You are a resident of a country where the use of the Website is illegal, or You are using the Website from a country where such use is illegal, we shall be entitled to immediately close Your Account. In such a case, any balance in the Account on the date of closure will be refunded to You as soon as practicable.

11. Placing Bets/ Gaming Using the Services  

11.1. To place a bet or access a Service, follow the instructions provided in the respective section of the Banzai Bet.

11.2. It is Your responsibility to ensure that the details of any bet, stake, or similar transaction (“Transaction”) that You place using the Services are correct when using the Website (either directly, through an application, or otherwise) in accordance with the relevant Game Rules, as appropriate.

11.3. You can access Your Transaction history by clicking on My Account on the Website or through our Customer Services team (including by opting to receive a written statement).

11.4. Banzai Bet reserve the right to refuse the whole or part of any Transaction requested by You at any time at our sole discretion or if You have breached the Terms of Use. No Transaction is accepted by us until You have given the appropriate confirmation (or it has otherwise been accepted by us) in accordance with paragraph 11.2. If You are in any doubt as to whether a Transaction has been successfully accepted, You should contact [email protected].

11.5. Once a Transaction has been accepted by us, You cannot cancel the transaction unless we agree otherwise.

11.6. In respect of gaming, the relevant Game Rules shall specify the point at which no further stakes or bets will be accepted by us.

11.7. Banzai Bet may cancel or amend a Transaction due to Collusion, Cheating, Fraud and Criminal Activity, Errors or Omissions, as well as the terms set out for Verification of Your Identity.

12. Online Betting or Gaming

12.1 When accessing the Services via an electronic form of communication, please be aware of the following regarding your use of the Website for placing bets or playing games:

12.1.1 You may be using a connection or equipment that is slower than that used by others, which could affect your performance in time-critical events offered on the Website.

12.1.2 You may encounter system flaws, faults, errors, or service interruptions, which will be addressed in accordance with the IT Failure section below.

12.1.3 The Game Rules of Banzai Bet for each event or game offered on the Website are available and should be reviewed by you before using the Services provided on the Website.

13. Fraud Criminal Activity, Collusion and Cheating

13.1. The following practices in relation to the Services constitute “Prohibited Practices” and are not allowed. Engaging in any of these practices will be considered a material breach of the Terms of Use:

  • Abuse of bonuses or other promotions;
  • Using unfair external factors or influences (commonly known as cheating, including but not limited to arbitrage betting/sure bets);
  • Taking unfair advantage (as defined below);
  • Opening any Duplicate Accounts;
  • Undertaking fraudulent practice or criminal activity (as defined below);
  • Multiple betting on the same outcome of one event;
  • Multi-sessions from one Account (multiple active sessions from one Account).

Banzai bet will take all reasonable steps to prevent and detect such practices (including but not limited to voiding all winnings, suspending withdrawals from the Account, closing the Account without refunding the balance, and other actions at our sole discretion) and to identify the relevant players concerned if they occur. We will not be liable for any loss or damage You may incur as a result of any Prohibited Practices, and any action we take in respect of the same will be at our sole discretion.

13.2. If You suspect a person is engaged in any Prohibited Practice, You should report it to us as soon as reasonably practicable by emailing Customer Services.

13.3. You agree that You will not participate in or be connected with any form of Prohibited Practice in connection with Your access to or use of the Services.

13.4. If:

13.4.1. Banzai Bet have reasonable grounds to believe that You have participated in or have been connected with any form of Prohibited Practice (based on fraud, cheating, and collusion detection practices used in the gambling and gaming industry at the relevant time); or

13.4.2. You have placed bets and/or played online games with any other online provider of gambling services and are suspected of any Prohibited Practice or improper activity; or

13.4.3. Banzai Bet become aware that You have “charged back” or denied any purchases or deposits made to Your Account; or

13.4.4. In our reasonable opinion, Your continued use of the Services may be detrimental to our regulated status, including our continued ability to be licensed by the Licensing Authority; or

13.4.5. You become bankrupt or undergo similar proceedings anywhere in the world,

Then, we shall have the right, in respect of Your Account (and/or any other account held by You with an Operator or other company of the Group) to withhold the whole or part of the balance and/or recover from the account the amount of any deposits, pay-outs, bonuses, or winnings affected by or attributable to any of the events in this paragraph. These rights are without prejudice to any other rights (including common law rights) we may have against You.

13.5. For the purposes of the Banzai Bet Terms of Use:

13.5.1. “Fraudulent practice” includes, without limitation: (a) fraudulent charge-backs and rake-back activity; (b) using a stolen, cloned, or unauthorized credit or debit card as a source of funds; (c) colluding with others to gain an unfair advantage (including through bonus schemes or similar incentives offered by us); (d) registering false or misleading account information; and (e) any act or attempted act deemed by us to be illegal, made in bad faith, or intended to defraud us and/or circumvent contractual or legal restrictions.

13.5.2. “Criminal activity” includes, without limitation, money laundering and any offence under any law or regulation in Your country, where You are playing from, or where Your IP has been registered.

13.5.3. “Unfair advantage” includes, without limitation:

  • Exploiting a fault, loophole, or error in our or any third party’s software used by You in connection with the Services;
  • Using third-party software or analysis systems;
  • Exploiting an Error as defined below to Your advantage and/or to our disadvantage or others.

13.6. In exercising any of our rights in relation to a Prohibited Practice, we shall use all reasonable endeavors to ensure that, while complying with our regulatory and other legal obligations, we exercise such rights in a manner that is fair to You and our other Clients.

13.7. Banzai Bet reserve the right to inform relevant authorities, other online gaming or gambling operators, other online service providers, banks, credit card companies, electronic payment providers, or other financial institutions of Your identity and any suspected Prohibited Practice by You. You shall cooperate fully with us to investigate any such activity.

14. Closure and Termination

14.1. Provided that Your Account does not show a balance due to us, You are entitled to close Your Account and terminate the Terms of Use with at least twenty-four hours’ notice by contacting us at [email protected]:

14.1.1. Indicating Your wish to close Your Account; and

14.1.2. Stating the reasons for closing Your Account, particularly if due to concerns over Your usage level.

14.2. Banzai Bet will respond to Your request within a reasonable time, confirming the closure of Your Account and the date it will be effective. You remain responsible for all activity on Your Account until we have processed the closure (at which point the Terms of Use will terminate).

14.3. When You request closure of Your Account under paragraph 14.1, we will, subject to paragraph 13.3, return any outstanding balance in Your Account to You.

14.4. Upon termination of Your Account under this paragraph 14, we may withhold from the repayment of the outstanding balance any monies: (a) due to Collusion, Cheating, Fraud, and Criminal Activity; (b) due to a Breach of the Terms of Use; (c) as otherwise provided by the Terms of Use; or (d) as required by law or regulation.

14.5. When repaying the outstanding balance on Your Account, we will use the same payment method You provided upon registration, or another payment method we may reasonably select.

14.6. If You have closed Your Account, we may re-open it with the same details upon Your request. However, it will be subject to the Terms of Use in force at the re-opening date, and any prior entitlements (including bonuses or contingent winnings) will no longer be valid.

Closure and Termination by Us

14.7. Banzai Bet are entitled to close Your Account and terminate the Terms of Use at any time with notice (or attempted notice) to You using Your Contact Details. In the event of such termination, we will refund the balance of Your Account as soon as reasonably practicable following a request from You.

14.8. If Banzai Bet close Your Account and terminate the Terms of Use due to Collusion, Cheating, Fraud and Criminal Activity, or Breach of the Terms of Use, the balance of Your Account will be non-refundable and deemed forfeited by You to the extent of any claim we may have against You at the date of closure (whether under Your Account, a Duplicate Account, or otherwise). Closure of Your Account and Termination of the Terms of Use, other than pursuant to paragraphs 13 or 22 of these General Terms, will not affect any outstanding bets, provided they are valid and You are not in breach of the Terms of Use. For the avoidance of doubt, we will not credit any bonuses into Your Account, nor will You be entitled to any contingent winnings, after the date on which it has been closed (whether by us pursuant to the Terms of Use or in response to Your request).

Suspension by Us

14.9. Banzai Bet are entitled to suspend Your Account in the circumstances expressly set out in the Terms of Use. Upon suspension of Your Account: (a) no activity will be permitted (including deposits, withdrawals, betting, or gaming) until it is reactivated by us; (b) no bonuses or contingent winnings will be credited to the Account; and (c) we will address the issue that led to the suspension with the aim of resolving it as soon as reasonably practicable so that the Account can either be re-activated or closed.

15. Access to and Use of the Services

15.1. You are solely responsible for the supply and maintenance of all of Your Access Devices and related equipment, networks, and internet access services required to access the Services. Banzai bet will not be liable for any losses caused to You (whether from loss of service, poor internet connectivity, insufficient bandwidth, or otherwise) by the internet or any telecommunications service provider that You have engaged to access the Services. For clarity, the Operator does not make any representation or give any warranty regarding the compatibility of the Services with any particular third-party software or hardware, including third-party analysis tools that promise certain results from any of the Services.

15.2. Under no circumstances should You use the Services for any purpose that is or is likely to be considered defamatory, abusive, obscene, unlawful, of a racist, sexist, or discriminatory nature, or that could cause offense. You must not use abusive or aggressive language or images, swear, threaten, harass, or abuse any other person, including other users, via the Website, or attempt to impersonate any other person, or behave in such a manner towards any Operator staff providing the Services, Customer Services, or any helpdesk or support function made available to You.

19. IT Failure

If such problems cause a game to be interrupted in circumstances where it cannot be restarted from exactly the same position without any detriment to You or other players, we will take all reasonable steps to treat You fairly. 20. Errors

 20.1. A number of circumstances may arise where a bet or wager is accepted, or a payment is made by us in error. A non-exhaustive list of such circumstances includes:

20.1.3. Where Banzai Bet have continued to accept bets on a market that should have been suspended, including where the relevant event is in progress (except where ‘in-running’ bets are accepted) or has already finished (sometimes referred to as ‘late bets’);

20.1.4. Where an error has been made as a result of a Prohibited Practice;

20.1.5. Where Banzai Bet should not have accepted, or have the right to cancel or re-settle, a bet according to the Betting Rules (for example, due to ‘Related Contingencies’);

20.1.6. Where an error is made by us regarding the amount of winnings/returns paid to You, including as a result of a manual or computer input error; or

20.1.7. Where an error has been made by us regarding the amount of free bets and/or bonuses credited to Your Account,

Such circumstances being referred to as an “Error.”

20.2. Banzai Bet reserve the right to:

20.2.1. Correct any Error made on a bet placed and re-settle it at the correct price or terms that were available or should have been available through the Operator (absent the publishing error) at the time the bet was placed, and the bet will be deemed to have taken place on the usual terms for that bet; or

20.2.2. Where it is not reasonably practicable to correct and re-settle under 20.2.1 above, declare the bet void and return Your stake to Your Account; or

20.2.3. In circumstances where the Error has resulted from a Prohibited Practice, take the steps outlined in these Terms of Use.

20.3. Any monies credited to Your Account, or paid to You as a result of an Error, shall be deemed held by You in trust for us and must be immediately repaid to us when a demand for payment is made. Where such circumstances exist, if You have monies in Your Account, we may reclaim these monies pursuant to the Terms of Use. We agree to use all reasonable endeavors to detect any Errors and inform You of them as soon as reasonably practicable.

20.4. Neither Banzai Bet (including our employees or agents) nor our partners or suppliers shall be liable for any loss, including loss of winnings, resulting from any Error by us or an error by You.

20.5. You must inform us as soon as reasonably practicable if You become aware of any Error.

20.6. Where You have used monies credited to Your Account or awarded to You as a result of an Error to place subsequent bets or play games, we may cancel such bets and/or withhold any winnings You may have won with such monies. If we have paid out on any such bets or gaming activities, such amounts shall be deemed held by You in trust for us, and You must immediately repay any such amounts when a demand for repayment is made by us.

21. Exclusion of Liability

21.1. Your access to and use of the Services is at Your sole option, discretion, and risk. Banzai Bet shall not be liable for any attempts by You to use the Services by methods, means, or ways not intended by us.

22.3. Banzai Bet have the right to disable any user identification code or password, whether chosen by You or allocated by us, at any time, if, in our reasonable opinion, You have failed to comply with any of the provisions of the Terms of Use.

22.4. In addition to any other remedy available, if You breach any of the Terms of Use, we shall be entitled to recover from Your Account any positive balance to the extent of any amount reasonably claimed against You pursuant to paragraph 22.1.

29.2. Banzai Bet performance is deemed to be suspended for the period that the Force Majeure Event continues, and we will have an extension of time for performance for the duration of that period. We will use our reasonable endeavors to bring the Force Majeure Event to a close or to find a solution by which our obligations may be performed despite the Force Majeure Event.

30. Waiver from Participation

30.1. If we fail to insist upon strict performance of any of Your obligations or if we fail to exercise any of the rights or remedies to which we are entitled, this shall not constitute a waiver of such rights or remedies and shall not relieve You from compliance with such obligations.

30.2. A waiver by us of any default shall not constitute a waiver of any subsequent default.

30.3. No waiver by us of any of the provisions of the Terms of Use shall be effective unless it is expressly stated to be a waiver and is communicated to You in writing in accordance with paragraph 27 (Complaints and Notices) above.

31. Severability

31.1. If any of the Terms of Use are determined by any competent authority to be invalid, unlawful, or unenforceable to any extent, such term, condition, or provision will, to that extent, be severed from the remaining terms, conditions, and provisions which will continue to be valid to the fullest extent permitted by law.

31.2. In such cases, the part deemed invalid or unenforceable shall be amended in a manner consistent with the applicable law to reflect, as closely as possible, the Operator’s original intent.

32. Full Agree

32.1. The Terms of Use and any document expressly referred to in them represent the entire agreement between You and us and supersede any prior agreement, understanding, or arrangement between You and us, whether oral or in writing.

32.2. Banzai Bet each acknowledge that neither of us has relied on any representation, undertaking, or promise given by the other or implied from anything said or written in negotiations between us except as expressly stated in the Terms of Use.

32.3. Neither party shall have any remedy in respect of any untrue statement made by the other, whether orally or in writing, prior to the date of the contract (unless such untrue statement was made fraudulently) and the other party’s only remedy shall be for breach of contract as provided in the Terms of Use.

33. Third Party Rights

33.1. Unless these Terms of Use expressly state otherwise, a person who is not a party to these Terms of Use has no right to enforce any of the terms.
